Model constitution

Many different terms can be used for a voluntary organisation or charity's governing document. Most, if not all PTAs, will be unincorporated associations meaning that your association's governing document will be referred to as a constitution. The constitution is probably the most important document your association has as it helps the elected committee members or trustees (if you are a registered charity) govern the organisation. It will contain a range of information and powers to assist trustees and to accurately reflect the purpose of the charity and the activities it can and cannot undertake to fulfil its aims. For more information about why your association needs a constitution and how you set about adopting a new governing document please see our Information sheet, PTA-UK Model constitution - information.

The creation of a governing document is understandably complex. To assist our members PTA-UK has produced two model constitutions; one for members in Northern Ireland and the other for members in England and Wales.

England and Wales

The PTA-UK model constitution has received approval from the Charity Commission for England and Wales when adopted without change, enabling PTAs to achieve charitable status in as little as 10 working days. For more information about becoming a registered charity please read our Information sheet: Charity registration - England and Wales. Members in Wales have access to the model constitution in Welsh. To request a copy please contact Nicole James, PTA-Cymru Adviser.

Northern Ireland

HMRC Charities Division recognise the model constitution, for the purposes of charitable registration. PTA-UK is currently consulting with the Charity Commission for Northern Ireland (CCNI) to seek approval of the constitution for the purposes of registration, once the need to register becomes a legal requirement. For more information about registering as a charity please refer to our Information sheet: Charity registration - Northern Ireland. PTAs in Northern Ireland that require a copy of the constitution should contact Jayne Thompson, PTA-NI Adviser.
